Welcome to Within the Hour. These Terms and Conditions (“Terms”) govern your use of our website, mobile application, and services (collectively, the “Platform”). By accessing or using Within the Hour, you agree to be bound by these Terms. If you do not agree, please do not use our Platform.
1. Overview of Our Service
Within the Hour is a digital platform that helps individuals connect with last-minute availability for healthcare and wellness services. Through real-time waitlist management, push notifications, and geo-targeted alerts, the Platform facilitates fast and efficient connections between users and service providers.
2. Eligibility
You must be at least 18 years old to use the Platform. By registering or using the Platform, you confirm that you meet this requirement and are legally able to enter into this agreement.
3. Accounts and Registration
You may need to create an account to access certain features. You agree to provide accurate, current, and complete information, and to keep it updated. You are responsible for safeguarding your login credentials and for all activity under your account.
4. Use of the Platform
4.1 For Users (Patients/Clients)
- You may join waitlists and receive real-time push notifications when service slots become available, including from providers or categories you have favorited.
- Favoriting services enables notifications tailored to your preferences and location. You are responsible for enabling notifications on your device.
- If you accept a time-sensitive alert, you are committing to attend the appointment or notify the provider if you are unable to come.
- If you join a short-term digital waitlist (e.g., in an emergency room or urgent care setting) that allows you to leave the facility, you acknowledge the following:
- You do so at your own risk.
- You are responsible for returning promptly upon notification.
- You understand that triage order, clinical prioritization, and exact wait times are not guaranteed.
- Repeated no-shows or misuse of the system may result in temporary or permanent restrictions to your account.
4.2 For Providers (Clinics/Organizations)
- You may manage one or more lists and notify users of immediate availability.
- Notifications may be sent to users who have favorited your service, favorited a related category, or are located within a specified radius.
- Push notifications must be used only for legitimate, open appointment slots or time-sensitive opportunities.
- Providers are responsible for managing their own capacity, evaluating user responses, and ensuring all communications comply with applicable laws and professional regulations.
- Abuse of push notifications (e.g., spamming users or repeatedly advertising unavailable slots) may result in suspension from the Platform.
5. Privacy and Data Use
We take privacy seriously. For health-related services, we comply with the U.S. Health Insurance Portability and Accountability Act (HIPAA). All personal and health information is stored and transmitted securely.
For non-medical services, we use industry-standard security practices to protect user data. Full details are outlined in our [Privacy Policy].
6. Fees and Payments
6.1 Users:
The Platform is free to use for individual users unless otherwise specified.
6.2 Providers:
Subscription fees and per-slot fulfillment charges may apply. Pricing plans, including Basic and Premium tiers, are detailed on our website or provider dashboard.
7. Cancellations, No-Shows, and Notification Misuse
- Users: Accepting an appointment but failing to attend without cancellation may result in restrictions on your ability to receive alerts.
- Providers: Repeated misuse of push notifications or misrepresentation of slot availability may result in penalties or platform suspension.
- The Platform reserves the right to limit the number of alerts you send or receive in a given period to maintain fairness and service quality.
8. License and Restrictions
You are granted a limited, non-exclusive, non-transferable license to use the Platform for its intended purposes. You may not:
- Reverse engineer or duplicate the Platform;
- Use the Platform to harass or abuse others;
- Circumvent any security or usage limits placed on the Platform.
9. Disclaimers

The Platform is not a substitute for medical judgment, emergency services, or triage. Availability is not guaranteed, and providers may cancel or reassign slots at their discretion.
10. Limitation of Liability
To the fullest extent permitted by law, Within the Hour, its affiliates, officers, agents, or licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Missed or delayed appointments;
- Health outcomes resulting from failure to return to a clinic in time after leaving a physical waitlist;
